Scope

This privacy policy (the “Privacy Policy”) explains how Biba Ventures (“Biba,” “we,” “our,” and/or “us”) collect, use, and share the information we collect when you use our website and mobile apps (collectively, our “Services”).

Biba games are mobile games for you, the parent, to play with your children on the playground. These games are intended to get kids physically active and having fun on playgrounds. Our Home Kit games are intended to achieve this same objective at home.

Biba Play Tracker is an older app you, the parent, could optionally use to connect to Biba games to let you track your child’s physical progress on the playground through their Biba gameplay. This app and its associated services have been discontinued.

Information we collect

A) Information You Provide to Us

Registration Information. You do not need to create an account to play Biba games.

Profile Information. Biba games do not require a profile to be made of any sort.

Communications. If you contact us directly, we may receive additional information about you. For example, when you contact our Customer Support team, we may receive your name, email address, phone number, and the contents of any message or attachments that you may send to us, as well as any other information you choose to provide.

B) Information We Collect When You Use Our Services

Location Information. When you play Biba games with your child, if you have opted into location services upon game launch, we collect location information from your device in order to show playgrounds near you using our map service. You may opt out of this service through your device settings at any time. Note that while our Biba playground games may request location data for the features mentioned above, our Biba Home Kit games do not contain or ask for any location services of any sort.

Device Information. When you use Biba games we receive information from your device, including a unique ID for distinguishing you as a separate user from others, an IP address, your phone operating system version and the device type. When you use our website, we receive web browser type, IP address and operating system version.

Usage Information. We automatically receive analytic information about your general interactions with our Services, such as the frequency/duration of play sessions, any game crashes, in-game activity along with the dates and times of play sessions.

Information from Website Cookies and Similar Technologies. On our website, we and our analytics service providers collect information through the use of “cookies” and similar technologies to understand how you navigate through and interact with our Services, to learn what content is popular, for authentication and advertising purposes, and to save your preferences. Website cookies are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. You should consult your web browser to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of our Services.

How we use the information

We use the information we collect to:

• Provide, improve and expand our Services, which include sharing aggregate reports about general playground usage trends with park boards and park and playground owners;
• Analyze how you use our Services;
• To show you nearby playgrounds and Biba playgrounds;
• To fix or remedy any bugs or crashes in our games;
• Communicate with you, either directly or through one of our service providers, including for informational purposes; and
• Respond to customer support questions.

How we share information

A) Service Providers

We share your information with service providers that perform authentication or analytics services on our behalf, including all of the uses described in Section 3 above. These services include Google Cloud, Firebase, Unity Crash Reporting (using the child app privacy setting) or any in-app purchase facilitation services (i.e. Google Play or iOS App Store)

B) Aggregate Information

We only share anonymous and aggregated reports generated through the use of our Services. For example, we share aggregated reports with park operators so that they can better understand how visitors are making use of their playground spaces.

C) Other Sharing

We may share your information with third parties in the following cases:

• While negotiating or in relation to a business transaction, such as a merger, sale of assets, or bankruptcy;
• Where disclosure is required or appropriate in order to comply with laws, regulations, legal process, or a governmental request;
• With law enforcement officials, government authorities, or third parties, if we think doing so is necessary protect the rights, property, or safety of Biba, our users, or the public;
• To protect the security or integrity of our Services;
• To enforce our agreements, policies, and terms & conditions;
• To respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person;
• To investigate and defend ourselves or others against any claims or allegations; and
• Whenever you consent to the sharing.

We do not share your personal information such as your name, location information, device information or email address with third parties for marketing or promotional purposes.

Your Choices

Profile Information. You can request or have our systems forget any usage or profile information generated through the use of Biba Games or Biba Play Tracker through the Settings in either of those apps.

Location Information. While you can prevent your device from sharing location information at any time through your device’s operating system settings, without location information we will not be able to provide you with all features of our Services.

Email Subscriptions. In the event that we send such emails, you can always unsubscribe from any promotional emails via the link provided in the emails. Even if you opt out from receiving promotional messages from us, you will continue to receive administrative messages from us. Where required under applicable law, we’ll obtain your prior opt-in consent to send you electronic marketing communications.

Data Security

We are committed to protecting your information. Even though we take precautions to protect users’ data, no security measures can be 100% secure, and we cannot guarantee the security of users’ data.

Third Party Links

Our Services may contain links to other websites, products, or services that we do not have control over such as the Apple App Store or Google Play store. Please be aware that we are not responsible for the privacy practices of such third parties. We encourage you to read their privacy policies before giving them your information.

Children’s Privacy

Our Services are for parents’ use, to facilitate their child’s play at the playground, or in the case of our Home Kit games, at home. We do not knowingly collect personal information from children under 13. If we find out that a child under 13 has given us personal information, we will take steps to delete that information. If you believe that a child under the age of 13 has given us personal information, please contact us at privacy@playbiba.com or avail yourself of the data management function in your Biba Games to request the data in question or have our systems forget that data.

Changes

We may make changes to this Privacy Policy from time to time. If we make any changes, we will notify you by revising the “Effective” date at the top of this Privacy Policy. If we make any material changes, we will let you know through the Services, by email, or other communication should we have the means to do so.
